Landuse: Earthworks associated with a residential subdivision to establish building platforms, to exceed the maximum vehicle movements numbers, and to establish vehicle crossings in non-compliance with the sight line and

separation distances, in the Medium Density Residential Zone 2

The actual and potential effects created by the proposal are acceptable for the following reasons:

  • The subdivision will result in residential development of a scale consistent with the Medium Density Residential Zone 2, being the operative zoning of the site.
  • All residential lots will be appropriately serviced with respect to water supply, including for firefighting purposes, wastewater disposal, stormwater management, electricity supply and telecommunications supply.
  • The proposal will maintain the safety and efficiency of the roading network.
  • The proposed earthworks are considered appropriate for the size and scale of the development and the proposal is considered geotechnically viable.
  • Any construction and earthworks related effects can be effectively managed through the use of appropriate conditions including compliance with the construction noise standards and limits on the hours of works and duration.

The proposal is consistent with the objectives and policies of the Operative District Plan and Waikato District Plan – Operative in Part.

The subdivision meets the provisions of section 106 of the RMA because legal and physical access is provided for and the applicant has addressed the risks of natural hazards through design and mitigation measures proposed.

The proposal is consistent with the operative Waikato Regional Policy Statement and all other relevant matters.

Overall, the proposal meets the purpose (section 5) and principles (sections 6-8) of the Resource Management Act 1991.
