The Project
Non-Complying Activity consent - the hardest category in the District Plan. A mosque and community centre in a residential zone, facing scrutiny on noise, traffic, and light spill. We secured it by running a rigorous effects-based case that left council nothing to refuse.
The Challenge
A mosque and community centre in a Residential Zone is classified as a Non-Complying Activity - meaning council starts from a presumption of refusal and you have to prove that granting consent would not be contrary to the objectives and policies of the plan. Every neighbour concern about prayer times, Friday traffic, Ramadan gatherings, and outdoor lighting becomes a potential ground for refusal. This is not a consent where you can submit a standard application and hope for the best.
The Solution
We built the entire application around effects-based planning - proving with certified technical evidence that the facility could coexist with its residential neighbours on every dimension that mattered. For noise, we designed 1.8m acoustic barriers along boundaries and imposed strict operational controls prohibiting amplified sound before 7am, protecting sleep amenity for the worst-case scenario. For traffic, we developed a comprehensive Traffic Management Plan requirement specifically for major religious events - Hajj, Ramadan - with documented procedures for managing peak vehicle flows and preventing street congestion. For light, we imposed strict limits of 3 lux maximum at the boundary, verified by a lighting engineer, ensuring the facility would not intrude on neighbouring properties at night.
The Outcome
