The Project

A full commercial hub - medical centre, retail, offices, childcare - in a Medium Density Residential Zone. It breached parking rules, setback rules, and signage rules. We still got it consented, because we know how to run a Discretionary Activity application.

The Challenge

Your commercial precinct makes perfect sense for the neighbourhood. The residents need it. The roading supports it. But the District Plan puts the site in a Medium Density Residential Zone, meaning your proposal is a Discretionary Activity that breaches parking requirements, setback rules, and signage standards all at once. Council can decline a Discretionary Activity application on any of those grounds. One poorly argued assessment and you have nothing.

The Solution

We used what we call a technical invisibility strategy - proving to council that despite the non-compliances, the activity's effects on the surrounding residential environment were less than minor. On parking, we ran a detailed traffic analysis demonstrating that shared parking across the mixed uses would function safely despite the District Plan shortfall - and council accepted it. On amenity, we imposed strict limits on signage (max 30 square metres) and required certified lighting plans to prevent light spill into neighbouring homes, giving council specific conditions rather than vague assurances. On building placement, we enforced specific setbacks (1.2m) for office blocks to maintain spatial separation from residential boundaries.

The Outcome

Consent granted for a high-value commercial precinct in a residential growth area. If your project is a Discretionary Activity that breaches District Plan standards, the answer is not to downscale - it is to build an application that proves the effects are manageable.
